These Terms of Service ("Terms") govern your access to and use of the website elev8labs.is (the "Site") and all products and services offered by Elev8 Labs ("we," "us," or "our"). By browsing, registering an account, or placing an order you agree to be bound by these Terms. If you do not agree, please refrain from using the Site.

1. Eligibility

You must be at least 21 years of age to browse or purchase from Elev8 Labs. By using the Site, you confirm that:

• You meet the minimum age requirement
• You have the legal authority to enter into binding agreements
• Your use of the Site complies with all applicable local, provincial, state, and federal laws

2. Research Use Only Products

By purchasing from Elev8 Labs, you acknowledge and agree that:

• You are a qualified researcher, or you represent a legitimate research institution or laboratory
• You understand the risks involved in handling research-grade compounds
• You will not use any product for personal, diagnostic, therapeutic, or recreational purposes
• You will handle, store, and dispose of all products in accordance with applicable safety regulations
• You accept full responsibility for the lawful use of any products you purchase

3. Account Registration

You may create an account to streamline future orders. When doing so you agree to provide accurate, current, and complete information, maintain the confidentiality of your login credentials, and notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or are associated with fraudulent activity.

4. Order Acceptance & Cancellations

All orders placed through the Site constitute an offer to purchase. We reserve the right to accept or decline any order at our sole discretion. An order is not confirmed until you receive an order-confirmation email from us. We may refuse or cancel orders based on suspected misuse, shipping restrictions, incorrect or unverifiable billing / shipping information, or product unavailability or pricing errors. If an order is cancelled after payment has been captured, a full refund will be issued to the original payment method.

5. Pricing & Payment

All prices displayed on the Site are in US Dollars (USD) unless otherwise noted and are subject to change without prior notice. We are not responsible for typographical errors in pricing; in the event of such an error, we reserve the right to cancel the order.

Payments are securely processed via trusted third-party gateways, Interac e-Transfer, cryptocurrency or bank transfer. Elev8 Labs does not store any payment card details. By submitting payment, you represent that you are authorized to use the payment method provided. Orders paid by e-Transfer, crypto or bank transfer are processed once funds are received.

6. Shipping & Delivery

We strive to ship all orders the same or next business day after payment is received. Once shipped, delivery times depend on the carrier and destination. Tracking information is provided via email for every order.

Elev8 Labs is not responsible for delays caused by customs processing, carrier disruptions, incorrect addresses provided by the customer, or force majeure events. For full details, see our Shipping & Returns Policy.

7. Returns & Refunds

Due to the nature of research-grade products, returns are accepted only under limited circumstances:

• Damaged in transit — contact us within 48 hours of delivery with photos
• Incorrect item — contact us within 48 hours of delivery
• Sealed, unopened liquids and powders — may be returned within 7 business days of delivery (15% restocking fee)

Peptide products are not returnable. Refunds or replacements are issued at our discretion. For full details, see our Refund Policy.

8. Limitation of Liability

Elev8 Labs is not liable for any damages, injuries, losses, or claims arising from the misuse, mishandling, or improper storage of our products. The buyer assumes all risk and responsibility upon receipt and use of any product purchased from this Site. To the maximum extent permitted by law, Elev8 Labs, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site or any product.

9. Intellectual Property

All content on the Site — including text, graphics, logos, images, product descriptions, and software — is the property of Elev8 Labs or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

10. Prohibited Uses

When using the Site, you agree not to:

• Use any product for human consumption or non-research purposes
• Misrepresent your identity, affiliation, or purpose of purchase
• Attempt to gain unauthorized access to Site systems or other users' accounts
• Use the Site to transmit malicious software, spam, or any harmful material
• Scrape, data-mine, or harvest content from the Site without permission
• Resell products obtained from Elev8 Labs without authorization
• File a chargeback on a delivered order instead of contacting support

11. Third-Party Links

The Site may contain links to third-party websites or services. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party sites.

12. Indemnification

You agree to indemnify, defend, and hold harmless Elev8 Labs, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the Site, violation of these Terms, or infringement of any third-party rights.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved exclusively in the courts located in British Columbia, Canada.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after any modifications constitutes acceptance of the revised Terms.
